Iskra. bg recalls that the scandalous case of „Rosenez“ Park became public thanks to Konstantin Bachiyski. He was the first to raise the issue and give it publicity, as well as to reveal possible abuses of the Municipality of Burgas, the regional government and ministries, as well as party leaders and rulers.
Today, this case has become particularly topical again because of an inspection carried out in the municipality of Burgas by various institutions. The inspectors themselves refused to disclose to the media what documents were requested, but it later became clear that they were for “Rosenetz”. The local government announced that there were no violations because since 2012 these lands were awarded to the state by the court. The municipality did not interpret this decision, but implemented it and therefore by its own order it was deaccessioned to the state.
What is the truth about the “Rosenetz”case?
Already in the transitional parliament within the temporary committee, which dealt with the “Rosenetz” case, Konstantin Bachiyski revealed how by his order the mayor of Burgas Dimitar Nikolov had deaccessioned over 4600 acres in the forest park.
However, if we go back a little further we will see that “Rosenetz” has been a national park since 1934 by decree of King Boris III, which was promulgated in 1935. In 1944 everything was nationalized and given to Burgas Municipality to manage.
After 1989, people can get restitution for property they owned before 1944. The then mayor Ioan Kostadinov requested that the national park be returned to the municipality. There was a court ruling on this matter which effectively said that there was no way this park could be returned since it was managed by the local government anyway.
Then Yoan Kostadinov issued an act for its transformation into municipal property and the over 4600 acres in question became with a status where they could neither be sold nor anything else could be done with them. Meanwhile, a lawsuit is pending in court with Perchemliev, which is only 9 acres and which the Municipality of Burgas is losing. It is not clear whether the local government is defending its interests well in this case.
Then the current mayor Dimitar Nikolov, instead of deaccessioning only the lost 9 acres, by his order he deaccessioned all over 4600 acres. From that moment on, the former regional governor of Burgas, Valcho Cholakov, began to dispose of the land. He, in turn, carried out various dispositions of these properties.
From the conversation with Konstantin Bachiyski it became clear that he managed to find the order for writing off the over 4600 acres in question while he was checking the municipal archives along the research he was doing on the case of Ahmed Dogan’s summer barns in “Rosenetz” Park. He was then told that all the documents had been collected by Director of Municipal Property, Zhivko Dimitrov. Bachiyski started looking for him, but he did not answer his mobile phone. He even went to the place, but he still could not find it. This went on for a whole week.
Finally he decided to go to the archives of the municipality and started digging through the documents. Thus, he found that the Mayor had deeded these over 4,600 acres by an order that was the same number as an official Bread and Bakery order. After he left, Bachiyski was forced to go back to the archive because he got a call from the woman who worked there and she was crying on the phone. She told him that after he left, they went to her and took from the memory of the copier what documents Bachiyski had copied.
Seeing what he copied, the tension increased. The former municipal councilor was asked on what grounds he went to review documents in the archives and he cited the Law on Local Self-Government and Local Administration /LLSGA/ all of the administration are obliged to provide him with information related to his work. Then Zhivko Dimitrov himself appeared, whom Bachiyski could not find for a whole week.
