A driver was fined BGN 20 for parking in the area of the Sea Station in Burgas. Yavor Stoev himself announced the case on the social network Facebook, attaching the receipt, which was handed to him at the barrier when leaving the place.
The man explained to Iskra.bg that he had visited a restaurant at the Sea Station on Sunday. There were no free parking spaces in the designated area. He therefore left his car parallel to the sidewalk. According to him, many drivers park in this way, which he does not consider a violation.
His surprise was huge when, on leaving, he was handed a receipt for BGN 20 for improper parking. He asked to know on what grounds the sanction was imposed on him, and the barrier officer told him to call and get along with the company, without specifying which one. The area is managed by the State Enterprise „Port Infrastructure“.
„I told him – do you even know who has the right to impose such documents for improper parking? He gave me a fiscal receipt and we, in order to get out and not block the traffic, decided to pay 20 leva and get out of the Sea Station. However, I strongly disagree with this type of attitude, the treatment of each visitor. For me, this is a pure form of self-government and disregard for the law, because they have virtually no right to draw up such a document for me. If there was no report from the police, traffic police or at least from the Municipality of Burgas. We have not seen such documents. This receipt is handed to her by the gentleman at the barrier. He says he is not familiar at all. That is how he was ordered to hand over these notes.“, Stoev stressed.
He accused the director of the State Enterprise „Port Infrastructure“of incompetence for such actions, which are victims of residents and guests of Burgas.
Iskra.bg managed to talk to Director of the Branch of the Territorial Division „Port of Burgas“ Ivaylo Ivanov.
„I did not order. This is done by order of the Director General. The entire price list is determined there and is located on the website of the State Enterprise „Port Infrastructure“, which approves the price of paid parking. Specifically for the fine – in the same order is regulated a fine for parking outside the designated places, as well as a fine for lost ticket.“, he explained.
The news about the fine imposed in this way on Yavor Stoev from the State Enterprise „Port Infrastructure“ provoked violent reactions on the social network Facebook. Many users expressed their outrage at what happened:
„These fines are distributed by Karanenov, with the support of another gentleman who is in Primorets every day.“
„The director of port infrastructure has the right to impose an administrative penalty under the law on the Ministry of Interior or refer to the ordinance of the Municipality of Burgas for organization and compliance with traffic law, the question is whether the jurisdiction has to apply any of these laws and regulations !?“
„You can be sanctioned for improper parking either by the Traffic Police or the Municipal Police…in this case we are talking about self-government and this will fall in court immediately. Another question is who allows it.“

Victim Yavor Stoev is determined to defend his rights. He has already hired a lawyer to file a complaint with the State Enterprise „Port Infrastructure“ over the sanction imposed on him.
Iskra.bg also managed to contact a lawyer. He was adamant that there must be an Act for establishing an administrative violation act (AVA) or a traffic violation ticket in order for the driver to be sanctioned according to the rules. Such a fine cannot be imposed with a single receipt on the barrier, because in this way the driver is not given the opportunity to defend himself.
