Single joint stock company Straightline wants to be registered as a co-owner in state land in“the Rosenets“ forest park with identifier 07079.831.167 and an area of just over 35 acres according to the cadastral map. The company is the former owner of two neighboring land properties with ID. 07079.831.113 and 07079.831.114, with an area of 3775 sq. m. respectively, and 4397 sq. m.
The regional governor of Burgas, Plamen Yanev, appealed this request, since the property’s boundaries include areas of the seabed and the sea water area, which by law are public state property and the company could not acquire ownership of them. According to the Cadastral-Administrative Information System, the current cadastral map does not correctly reflect the border of the seashore.
Construction was also carried out on the state property without approved construction documents and permits – a massive three-story building, as well as a monolithic retaining wall, ending with a metal protective fence. The height of the wall is about 6.50 m and borders the seashore. Its function is to stabilize and fortify the two private properties currently owned by Hermes Solar ltd.
During the construction of the retaining wall, however, it was not positioned correctly and was built on the neighboring state property, and during an inspection by the competent authorities, no registered active landslide or strong erosion of the seashore was found, which would require the construction of the retaining wall.
