The beach next to Ahmed Dogan’s summer residence in “Rosenets” Park is no longer agricultural land, but has been officially declared a beach. This was announced by the MP from „Democratic Bulgaria“ Dimitar Naydenov, who until recently was a municipal councilor in Burgas. For him, this puts an end to the battle for the conquest of the beach seized by Dogan and the free citizens are victors over the backstage. Moreover, people will have access to the beach through a road that must be public property, Dimitar Naydenov explained to Iskra.bg.
„The beach was officially declared as such on the basis of my request from the summer of 2020. Then I submitted a request to the Ministry of Tourism to put this piece of land as a beach on the Specialized Map of the sea beaches, because then I noticed that it is not reflected on the map as a beach, but as agricultural land. I am aware that by law, when a beach is reflected as such on the specialized maps, public property must lead to it. You know the story of the Municipal Council vote, where I was also one of the misled municipal councilors who was deceived. Then I made a promise to citizens to do everything possible this time to be returned to them. That’s why I came up with such a strategy – to return the beach to the specialized maps, where it should be reflected as such, and not as an agricultural property, because if it is an agricultural property, there is not necessarily a road to it. But if it is a beach – the road is now mandatory and it cannot be private.„, said Naydenov.
He stressed that the Ministry of Tourism, under great public pressure, has started a procedure for including the beach in the specialized maps and has issued an order to the director of the cadastre for the application of this beach. But it was appealed by Ahmed Dogan’s architect Kalin Tiholov to the court to delay and present the beach as „self-forested terrain covered with soil, bushes and trees.“ However, the court ruled in favor of drawing the beach in specialized maps. This happened about a month ago. Then there was a technical procedure for the beach to be reflected, ie to change the map in the cadastre. This change is already a fact. Here is what Naidenov explained:
„The beach is already marked as such with an area, with permanent use as a beach. In this sense, the road that already leads to it can no longer be private, even if the court rules in Dogan’s favor, because the cases are still ongoing and there is such a possibility that the road will be lost in the court battle. But because of this new circumstance, we can now be sure that this beach cannot remain private, even if the Municipality has to conduct a procedure for expropriation of the road again, because the beach must be legally accessible.“
Thus, according to Naydenov, even the companies close to Dogan, which are suing the decision of the Municipal Council from July 2020, which cancels the scandalous vote in April to give Dogan the way to win the case, the road cannot pass again. in private hands. In practice, this means that the battle for the road to Ahmed Dogan’s summer residence has been finally won.
„As it is not clear how the cases will end, because there is a serious danger that Dogan will win the cases. But it will happen that the court will rule that the decision of the Municipal Council enters into force, i.e. the road passes to the companies of Ahmed Dogan, but on the other hand there is a new circumstance that requires the Municipality to provide a road to the beach by law. It cannot escape this commitment. This time, which is there, will have to be alienated again by the Municipality – by law, it has such a right, and return it to the citizens. The presence of a beach there ensures that there must be a road by law. Either a new road must be built or the Municipality must alienate the existing one.“, Naydenov shared, adding:
„The road becomes safe. That is, the Municipal Council or the mayor will never again be able to decide this time to be given to private ownership to anyone. And as we know very well, the goal this time to be given to Ahmed Dogan was not to be able to reach exactly to this beach so that people can’t go there, disturb its peace, see what boats stop at the illegal port.”
Naydenov told Iskra.bg that the case of the illegal port and the illegal buildings of Ahmed Dogan will also be developed by the end of the week. A proposal will be submitted to parliament to set up a special commission to investigate why the buildings are not demolished, once a regulation has been issued, but it is not yet being implemented.
Iskra.bg reminds that during the debates preceding the scandalous decision of the Municipal Council in Burgas on April 28, 2020, the first attitude in the case with the road in “Rosenets” Park was taken by the municipal councilor Konstantin Bachiyski. From then until today, he has been fighting for this decision not to be implemented and for the road to remain public municipal property. The case is also being dealt with by the Organization for Protection of Bulgarian Citizens, whose representatives have taken an active position on the case and are working for the triumph of justice for the benefit of society.
