Решението е свързано с дело, заведено в австрийски съд от Ева Главешинг-Пиешек, която поиска премахването на касаеща нея публикация във „Фейсбук“, която е можело да бъде видяна от всеки. Съдът намери публикацията за обидна и клеветническа.
„Законът на ЕС не пречи на доставчик на услуга като „Фейсбук“ да получи нареждане да премахва идентични и при определени обстоятелства еквивалентни коментари, предварително обявени за незаконни“, се казва в съобщение на Европейския съд.
„Освен това законодателството на ЕС не пречи на такова разпореждане да има ефект в световен мащаб в рамките на съответното международно право.“
През септември „Фейсбук“ обяви, че няма да сваля публикациите на политици, които нарушават стандартите на социалните мрежа. Видовете публикации на политици, които няма да бъдат санкционирани, може да включват жестоки или безчувствени коментари или графично съдържание. За момента не е ясно как новото решение на Европейския съд ще се отрази на тази политика.
