„The position of the Supreme Bar Council was announced in 2019 with the election of Ivan Geshev. It was stated in a special decision, which was taken by the Supreme Bar Council and filed with the Supreme Judicial Council, as a criterion for the election of the Prosecutor General and specifically for the election of Ivan Geshev then. The statement of the Supreme Bar Council, which is long before my term, is that Ivan Geshev does not meet the criteria set by the Supreme Bar Council for holding this position.“
This was commented by the Chairman of the Supreme Bar Council Ivaylo Dermendzhiev. According to him, the European institutions have long ruled that the powers of the Prosecutor General in our country are too great and need to be adjusted.
„It is clear that the Prosecutor General neglected the bar. Constitutional changes, although difficult or legislative, can change the powers of the Prosecutor General. „One of the reasons there is a lack of criteria for selecting such figures is that there are not enough representatives of the bar in the Supreme Judicial Council“, he added.
According to Dermendzhiev, the good news is the presence of more lawyers and attorneys in the new National Assembly.
„38 people are lawyers and attorneys in the National Assembly, which is about 20% of the parliament and assumes that lawmaking and legislative activity will be at a level we rely on“, he said, adding that the issue is not only there should be lawyers in the groups, but they should also be of good quality. He explained:
„Such as they understand the specifics of the specific law, which is adopted and voted accordingly. By definition, the law is a permanent settlement of public relations. It is assumed that a law, when written, must be as durable in years and time to perform its functions. What I have noticed lately is that laws are being written quickly and step by step, and are changing even faster, and not in the way a law is passed with public discussion and in the order in which it should be, but with some transitional concluding provisions that the public does not always understand what it is about.“
